1. Who we are

2. Business customers only
The service is offered to people acting wholly or mainly for purposes relating to their trade, business, craft or profession. By creating an account or subscribing, you confirm that you are acting for business purposes and have authority to bind the business you identify. If you are acting as a consumer, do not subscribe and contact us first.
3. The service
BuildPilot provides software for enquiries, communications, quotations, tender analysis, estimating, rate libraries, reporting, marketing and work-opportunity workflows. Features may develop over time, but we will not knowingly remove a material paid feature during a current billing period without a reasonable operational reason.
4. Accounts and authorised users
You must provide accurate registration information, keep credentials secure, limit access to authorised users and notify us promptly of suspected compromise. You are responsible for activity carried out through your account except to the extent caused by our failure to apply reasonable security controls.
5. Trial and subscription
Where offered, the trial lasts 7 days. The selected plan price is shown before checkout. A card is required. Unless you cancel before the trial ends, the selected plan converts automatically to a monthly paid subscription at the price shown at checkout and renews monthly until cancelled.
6. Billing and taxes
Stripe processes subscription payments. Prices are displayed in pounds sterling. Any applicable taxes are shown or handled as required. You must keep payment details current. If payment fails, access may be restricted after reasonable attempts to recover the amount.
7. Cancellation
You can cancel through BuildPilot billing controls or the Stripe billing portal. Cancellation is normally scheduled for the end of the current trial or paid period, so access continues until that date and no further renewal is taken. You can resume before the cancellation takes effect where the billing controls allow it.
8. Refunds
The Cancellation and refund policy forms part of these terms. Business subscription fees are generally non-refundable once a paid period has started, except where required by law or where we agree a charge was duplicated, incorrect or unauthorised.
9. AI-assisted output
AI output can be incomplete, inaccurate or unsuitable. It is decision-support and drafting assistance, not professional advice. You must review customer messages, tender findings, estimates, rate matches, risks, exclusions, qualifications and other material outputs before relying on or sending them.
10. Construction and commercial responsibility
BuildPilot is not a substitute for an estimator, quantity surveyor, solicitor, engineer, accountant, contract administrator or other competent professional. You remain responsible for scope, quantities, rates, programme, design, health and safety, tax, employment status, qualifications, insurance and contractual obligations.
11. Customer data
You retain ownership of content you upload. You give us the limited rights needed to host, process, analyse, back up and transmit that content to provide and secure the service. You confirm that you are authorised to provide the content and have a lawful basis for any personal data contained in it. Our Privacy Notice explains our data-protection roles. Where we process customer-controlled personal data as processor, the Data Processing Agreement forms part of these terms.
12. Confidentiality
Each party must use reasonable care to protect the other party's confidential information and use it only for the relationship, except where disclosure is required by law or to authorised service providers subject to appropriate obligations.
13. Work Feed
The Work Feed facilitates introductions and communications. BuildPilot is not the employer, employment agency, principal contractor, client, subcontractor, guarantor or payment intermediary unless separately agreed in writing. Users must verify identity, competence, right to work, insurance, qualifications, scope, rates and site requirements themselves.
14. Marketing and communications
You are responsible for ensuring that marketing communications have an appropriate lawful basis, use accurate sender details and include required opt-out mechanisms. BuildPilot suppression controls do not replace your legal obligations.
15. Acceptable use
You must comply with the Acceptable Use Policy. We may investigate suspected misuse and suspend access where reasonably necessary to protect users, comply with law or prevent harm.
16. Intellectual property
BuildPilot software, branding, documentation and design remain owned by the operator or relevant licensors. During an active entitlement, you receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.
17. Availability and changes
The service is provided on an as-available basis. Maintenance, faults, third-party outages, cyber incidents and beta functionality may affect availability. No service-level guarantee applies unless agreed separately in writing.
18. Suspension and termination
We may suspend or terminate access for material breach, unlawful use, security risk, non-payment or serious misuse. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue.
19. Liability
Nothing in these terms excludes or limits liability where the law does not allow it, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, anticipated savings, business opportunity or goodwill. Our total aggregate liability arising from the service is limited to the subscription fees paid or payable by you in the 12 months before the event giving rise to the claim. Any limitation applies only to the extent permitted by law.
20. Third-party services
The service depends on third-party hosting, payment, email, AI and infrastructure providers. Their outages or changes can affect BuildPilot. Where a third-party service has its own terms, your direct use of that service may also be subject to them.
21. Changes to these terms
We may update these terms for legal, security or product reasons. Material changes affecting an active paid subscription will be notified through the service or by email where reasonably practicable. Continued use after the effective date constitutes acceptance of the updated terms, subject to applicable law.
22. Governing law
These terms are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction.
